Freetown -and- Assethold Ltd appeal decision now handed down
The Recent decision in Freetown and Assethold Ltd put the issue of appealing an award under (section 10(17) ) well and truly in the spotlight. Time became an even greater issue when it was held by Mr Hochhauser QC in the county court and later by HHJ Mrs Justice Slade in the High Court, when each held that the effective date of the service of the Award was the date of posting and relied on C A Webber (transport) Ltd v Railtrack to support this judgement.
Lord Justice Rix, Lord Justice Patten, and The Chancellor of the High Court having heard and allowed the appeal.

Landlord Fixes roof Leak???????????
I thought I had seen it all until I got a call from my client who is the tenant on the ground floor of a commercial building. They had been complaining about a leak for several months and eventually the landlord agreed to instruct builders to repair the leaking roof. The photo’s show just how ingenious a roofer can be. When I asked him why he had not simply gone on to the roof and sheeted it externally. He said he was scared of heights!!!
I tried to explain that the idea was to stop the water getting into the building in the first place, rather than collecting it and then letting it flow out through the wall. he seemed very upset when I told him it was not acceptable.
