Mohammed & Lahrie v Antino & Stevens (2017) Mayors and City of London County Court
HHJ Bailey found in his judgement as follows
The heart of the Claimants’ case is submission (1) to which I will return. As to submission (2) Mr Isaac Counsel relies on the comment, at paragraph 17(j) of the judgment of Aikenhead J in the Dillard case, where he states:
“(17) It is accepted rightly that the parties may contractually opt out of the Act, as the parties have done here in part at least relating to the relief set out in Clauses 7 and 10 of the Deed.”
Mr Antino is greatly offended by the suggestion that owners may “contractually opt out of the Act”, and understandably so.
